BY PARTICIPATING IN THIS SWEEPSTAKES, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THE OFFICIAL RULES CAREFULLY BEFORE PARTICIPATING.

1. SWEEPSTAKES PERIOD

The original Margarita Game Sweepstakes (the "Sweepstakes") entry period opens on September 25, 2023, at 12:00:01 am/EST and will close on November 5, 2023, at 11:59:59 pm/EST (the "Sweepstakes Period").

2. SPONSOR

The Sweepstakes is sponsored by Remy Cointreau USA, Inc. with an address of 3 Times Square, 20^th Floor, New York, NY 10036 (hereinafter referred to as the "Sponsor").

3. ELIGIBILITY

The Sweepstakes is open to any legal and current resident of The United States of America and District of Columbia (“D.C.”) who are twenty-one (21) years of age or older as of August 15, 2023. Residents of New York, Puerto Rico, and Florida are not eligible. The Sweepstakes is subject to all applicable federal, state and local laws, rules and regulations, and is void outside the United States (including D.C.), void where prohibited by law, and void in New York, Florida, and Puerto Rico.

Employees, officers and directors of Sponsor, its parent companies, divisions, subsidiaries, affiliates, and advertising and promotion agencies of each of the foregoing, distributors and retailers, and any other entity that develops, produces, or distributes materials for or related to this Sweepstakes, and the immediate family members or households (whether related or not) of any of the above are not eligible to participate or win.

4. HOW TO ENTER

Method of Entry: Mobile Online Only.

The Sweepstakes entry is accessible on the following website https://www.cointreau.com/us/en/original-margarita-game/game hereinafter referred to as “the Website.” You may enter the Sweepstakes by filling out the online form via a mobile phone only. After completing the registration process, qualified entrants will be eligible for a chance to win. All internet entries must be received by 11:59:59 pm/EST on November 5, 2023, or they will be void. One entry per person per email address during the Sweepstakes Entry Period. In the event of a dispute regarding the identity of a participant’s mobile online entry, the entry will be deemed to have been made by the authorized holder of the email account at the time the entry was made. Winner will be selected by random drawing on or around November 8, 2023 from among all eligible entries received electronically. Winner will be notified by phone and/or email provided with instructions on how to claim his/her prize.

To enter the Competition and try his/her luck at winning, the participant must:
● Visit the Website ;
● Click on “REGISTER” to start registering ;
● Register and fill in the entry form as defined under Article 2 of the rules then click on
“VALIDATE” to validate the registration;

By confirming his/her registration, the participant becomes eligible to enter the draw and attempt to win the prize described under Article 4 "Draw".

On the homepage, the participant can, if he/she wishes, plays, complete and unlock rooms up to 6 rooms, thus increasing his/her own chances of winning up to 6 extra chances in the draw. One room completed is equal to one more chance in the draw.

The participant can, if he/she wishes, invite friends and family to enter the Competition on the Website, thus increasing his/her own chances of winning up to 7 extra chances in the draw:
● By Facebook, Messenger and WhatsApp in which case he/she will be subject to Facebook's general conditions of use;
● By providing a valid email address for his/her friend/family member in the field provided for this use;
● Via any application owned by the participant at the time of the Competition allowing him to share an invitation to his friends and family such as Instagram in which case he/she will be subject to the general conditions of use of these applications.

The participant can only send invitations to enter the Competition to individuals that are aged 21 or over and have a legal capacity.

Overall, the participant can gather up to 14 chances in the draw by:

- registering (1 chance for the draw)

- unlocking all of the 6 rooms (up to 6 extra chances for the draw)

- sharing and getting 7 friends registered to the competition (up to 7 extra chances for the draw)

For every person invited by the participant who decides to enter the competition, the participant will receive one (1) additional chance. The participant can share the Competition as many times as he/she wants, however, only the first seven people registered thanks to your invitation link will allow him/her to receive an additional chance. The email addresses of a participant’s friends provided by the former must be valid and different from one another for any benefit to be awarded to the participant’s account.

By submitting an entry, entrants fully and unconditionally agree to be bound by these Official Rules and the decisions of the Sponsor, which will be final and binding in all matters relating to the Sweepstakes.

5. PRIZES

Prize: One (1) Winner

One Sweepstakes (1) Winner (the “Winner”) will be chosen at the end of the Sweepstakes Entry Period and will win a trip for two (2) to France to discover Cointreau’s birthplace in Angers and the mixology scene in Paris including:

- Transportation: round trip from your home city to Paris and Angers
- 4 nights in France (Paris and Angers)
- Exclusive dinner and best bar discovery
- An original activity to discover Paris
- Visit of Cointreau's Distillery

The winner and the person chosen to benefit from the prize with him/her must be at least 21 years old at the start of the Sweepstakes (September 25, 2023).
Once the winner is chosen, winner has thirty (30) days to inform Sponsor of availability to complete travel.
- The available dates for travel: between 01/01/2024 to 01/01/2025, except for the following dates: from 01/07/2024 to 15/09/2024.
If the winner(s) cannot travel to France, then the winner can choose to receive an exclusive cocktail toolkit.
A Cointreau concierge will contact the winner(s) individually to schedule the details of the experience, by phone and email.
The Organizer reserves the right to replace any prizes with a prize of equivalent value, in particular, in the case that the initially planned prize is no longer available.

Any expense or cost not expressly stated in the description of the Prize set forth above is the sole responsibility of Winner.

Prizes are awarded “as is,” with no warranty or guarantee, either expressed or implied, by Sponsor. Prizes are not transferable or redeemable for cash. No substitutions of Prize by Winner are allowed, but Sponsor reserves the right to substitute a prize of equal or greater value. All taxes, fees, and surcharges on the Prize are the sole responsibility of Winner.

All federal, state, and local taxes, fees, and surcharges on any prize are the sole responsibility of Winner of the prize. Winners of prizes with a value of $600 or more will be issued an IRS Form 1099-MISC early in the year following the year in which prize was awarded for filing with his/her federal and state tax returns. Sponsor complies with all tax reporting requirements. The amount of any tax liability will vary depending on winner’s tax bracket.

The approximate retail value of the Prize in this Sweepstakes is USD $4,500.

6. GENERAL RULES OF PARTICIPATION

By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which shall be final, and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. All federal, state and local laws apply. All federal, state or other tax liabilities arising from this Sweepstakes will be the sole responsibility of the Winner. The Sponsor, its parent companies, affiliates, subsidiaries and advertising and promotion agencies are not responsible for and shall not be liable for: (i) late, lost, delayed, misdirected, incomplete or unintelligible entries, telephone system or computer malfunctions, lost connections or transmission errors; (ii) any injuries, losses or damages of any kind caused by the acceptance, possession or use of any prize or from participating in the Sweepstakes; or (iii) any printing, typographical, administrative or technological errors in any material associated with the Sweepstakes. Sponsor reserves the right, in their sole discretion, to modify, cancel or suspend this Sweepstakes should a virus, bug, computer problem or other causes beyond the Sponsor’s control corrupt the administration, security or proper play of the Sweepstakes. The Sponsor may prohibit you from participating in the Sweepstakes or winning a prize if, in their sole discretion, the Sponsor determines that you are attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other players or Sponsor’s representatives. CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION OF SUCH PARTICIPANT AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION

In the event of a dispute, the decision of the Sponsor shall be final and binding.
All entries and the information contained in such entries will become the Sponsor’s property and will not be acknowledged or returned.
Acceptance of a prize will constitute permission for the Sponsor to use the names, cities, states, likenesses, and voices of the Winner (and Winner’s guest) for advertising and promotional purposes, without any further compensation, unless prohibited by law.

7. WINNER SELECTION, NOTIFICATION, AND VERIFICATION

Selection will be conducted by Sponsor, and all decisions are final. Potential winners will be notified by the email provided on their mobile online entry submission. If any potential winner cannot be reached within three (3) days of first notification attempt, if any prize or prize notification is returned as undeliverable, if any potential winner rejects his/her prize, or in the event of noncompliance with these Official Rules, such Prize will be forfeited, and an alternate winner may be selected from all remaining eligible entries. Upon forfeiture of any prize, no compensation will be given. An affidavit must be signed, notarized and returned by the Winner to Sponsor within two (2) days of claiming the Prize.

Winner will be required to sign and return, where legally required, an Affidavit of Eligibility and Liability/Publicity Release. All documents must be returned by potential winners within one (1) day of notification that he/she is a potential winner. No potential winner will be an official winner until his/her Affidavit or Declaration of Eligibility and Liability/Publicity Release has been returned and eligibility has been formally verified by Sponsor. If any potential winner fails to comply with these Official Rules and/or to submit the required documentation within the designated time period, he/she will be automatically disqualified, and the prize may be awarded to an alternate winner.

8. LICENSE AND RELEASE

Participation in the Sweepstakes and acceptance of a Prize constitute Winner’s (and Winner’s guest’s) permission for Sponsor or its agents or affiliates to photograph, film, and record each winner and guest and to use his/her name, address (city and state), likeness, photograph, voice, biographical information, and/or any statements made by winner and guest regarding the Sweepstakes or Sponsor for purposes of trade, publicity, or promotion without notice or additional compensation, except where prohibited by law, including, but not limited to, social media, advertising, POS, public relations, for all perpetuity worldwide. By participating and/or accepting a Prize, entrants, winners, and guests acknowledge and agree that this Sweepstakes is in no way sponsored, endorsed, or administered by, or associated with a social media platform, including, but not limited to Instagram, Facebook, Tik Tok, and/or Twitter and agree to release and hold harmless Sponsor, Sponsor’s agents or affiliates, any and all social media outlets, Sponsor’s advertising and promotional agencies, and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers, and directors (“Released Parties”) from any and all liability for loss, harm, damage, injury, cost, or expense whatsoever, including, without limitation, property damage, personal injury, and/or death that may occur in connection with, preparation for, travel to, or participation in the Sweepstakes, or possession, acceptance, and/or use or misuse of Prize or participation in any Sweepstakes-related activity, including, but not limited to, any claims based on publicity rights, defamation or invasion of privacy, and merchandise delivery. Sponsor shall not be responsible for any cancellations, delays, diversions, substitutions, or omissions whatsoever by any transportation companies or any other persons providing any services to Winner (and guest), including any results thereof, such as changes in services or location necessitated by same. Sponsor is not responsible if any part of a Sweepstakes prize cannot be awarded due to acts of God, acts of war, natural disasters, weather, health epidemic, global pandemic, Covid-19, or acts of terrorism. Sponsor shall not be liable for any loss or damage to personal belongings related to acceptance of Sweepstakes Prize. Entrants who do not comply with these Official Rules or who attempt to interfere with this Sweepstakes in any way shall be disqualified. There is no purchase required to participate. A purchase does not increase odds of winning.

9. LIMIT OF LIABILITY AND DISCLAIMERS

A) ALL ENTRANTS AGREE THAT THE Sponsor, THEIR PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, AND AGENCIES AND/OR ANY OTHER PERSON OR ENTITY ASSOCIATED WITH THE SWEEPSTAKES SHALL NOT BE LIABLE FOR CLAIMS, LOSSES, LIABILITIES, EXPENSES OR INJURIES OF ANY KIND RESULTING IN ANY WAY FROM ENTRANTS’ PARTICIPATION IN THE SWEEPSTAKES, INCLUDING BUT NOT LIMITED TO, THE DRAWING, THE USE OF THE PRIZE, ANY DELAYED, LOST, MISDIRECTED, OR DAMAGED ENTRIES, OR ANY COMPUTER, ONLINE SERVICE, COMMUNICATIONS OR OTHER TECHNICAL MALFUNCTIONS THAT MAY OCCUR.

B) ALL ENTRANTS ACKNOWLEDGE THAT THE Sponsor, THEIR PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, AND AGENCIES AND/OR ANY OTHER PERSON OR ENTITY ASSOCIATED WITH THE SWEEPSTAKES MAKE NO WARRANTY OF ANY NATURE, EXPRESS OR IMPLIED REGARDING THE PRIZES, WHETHER WITH RESPECT TO FITNESS FOR PURPOSE, SATISFACTORY QUALITY, DESCRIPTION OR NATURE OF THE PRIZE OR OTHERWISE. ALL ENTRANTS, BY ENTERING THE SWEEPSTAKES, AGREE TO BE BOUND BY THE OFFICIAL RULES.

10. DISPUTES/CHOICE OF LAW

Except where prohibited, each entrant agrees that this Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules. Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules and ensure the fair operation of this Sweepstakes, including without limitation barring entrants who do not comply with these Official Rules. By entering, entrants consent to the jurisdiction and venue of the appropriate federal, state and local courts located in New York for any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded.

The information that you provide in connection with the Sweepstakes may be used by Sponsor, its marketing affiliates, and related entities or agencies in accordance with its Privacy Policy, which is found at https://www.cointreau.com/us/en/privacy-policy and which may be updated from time to time without formal notice to you
